The following are terms and conditions (the “Terms of Service”) of a legal agreement between you and Flowers for Florist from Ecuador in your Hands LLC by accessing, browsing, and/or using this website at https://www.flowersforflorist.com (the “Site”) you acknowledge that you have read, understood, and agree to comply with and be bound by the Terms of Service and to comply with all applicable laws and regulations (the “Agreement”). If you do not agree to these terms, do not use this Site. 

Description of the Services 

Flowers for Florist provides our customers with online access to purchase fresh cut flowers, preserved flowers and dried flowers. You may access our selection of flowers through our website and domains, including https://www.flowersforflorist.com, and all subdomains, webpages, and country level domain variants. We refer to all of these as our “Services.”   

YOU AGREE THAT BY USING OUR SITE AND SERVICES, YOU ARE AT LEAST 18 YEARS OF AGE AND ARE LEGALLY ABLE TO ENTER INTO A CONTRACT. 

User Submitted Content 

Any information you submit or upload to the Site, such as those relating to your account, profile, etc., created by you (“Your Content”) is your sole responsibility. This means that you, and not us, are entirely responsible for all of Your Content that you upload, post, link to, email, transmit or otherwise make available via the Services. You further agree to not intentionally provide false or misleading information on the Service.  

Payments 

All payments for products, purchased through the Site, are made throughStripe Payment Processor. As such, the third-party payment processor’s terms and conditions, privacy policy, etc., will apply, and it is your responsibility to read any such terms or policies. We will not process your order(s) until the third-party payment processor notifies us that the full payment has been received and the transaction is complete. All payment issues with the third-party payment processor, such as but not limited to, account cancellations, denials, or holds on your account are your sole responsibility. 

Stripe is a certified PCI Service Provider. This is the most stringent level of certification available in the payments industry.  

Refunds  

Flowers for Florist takes great pride in the quality of our products and service.  

As a family owned and operated business we understand the importance of customer satisfaction, word of mouth and repeat business. To ensure 100% customer satisfaction, Flowers for Florist guarantees to use the freshest available seasonal blooms and quality product in all our flowers. If you need assistance, our qualified team can also provide expert floral advice upon request, to ensure the most desired and appropriate end-product is delivered.  

In order to process a product substitution or refund it is a must to send via email: sales@flowersforflorist.com clear pictures of the product with its packing (card board & plastic sleeve) within 24 hours of receipt demonstrating the problem and the number of stems impacted. Your sales representative will contact you after analyzing the information received.   

By purchasing or otherwise using the Services, you agree that you have read our Refund Policy, that you understand our Refund Policy, and that you consent to the terms and conditions of our Refund Policy. 

Delivery 

Your flowers are carefully selected, cut, hydrated, packed, shipped and delivered from our prestigious farms in Ecuador directly to your doorstep.  

As a B2B company, we ship our flowers through our delivery partners, UPS, FedEx or DHL, flowers will arrive within 4 business days from the order date or you can select the delivery date of your preference. 

We suggest you place your orders at least 1 week to 4 weeks in advance prior to your delivery date. For Holidays the earlier the better. Your flowers will not be cut until the day that we ship them to ensure freshness.

Deliveries are made from Monday through Friday. We do not guarantee delivery of products at a specific time of the day. However, our delivery partners will attempt to make deliveries before noon in the recipient’s time zone. 

Deliveries do not require a signature. Moreover, our delivery partners may, in their sole discretion, leave products at the delivery address without obtaining a signature prior to delivery. However, if delivery is not possible, our delivery partners may attempt to redeliver the products at a later date or time, or may hold the products at their location. We are not responsible for any delays or additional charges that may result. 

We assume no responsibility if the delivered product(s) is damaged due to being left outside in the heat, rain, etc., or if the package is stolen after being delivered to the correct delivery address. 

By purchasing or otherwise using the Services, you agree that you have read our Delivery Policy, that you understand our Delivery Policy, and that you consent to the terms and conditions of our Delivery Policy. 

Delays: 

Although UPS, FedEx & DHL are always on time, Flowers for Florist will not be responsible for logistics delays. Credits won´t be accepted. 

We are not responsible for any delays in delivery due to an incorrect delivery address. After your order is placed, any changes to the delivery address may only be accomplished through our delivery partners. We are not responsible for any additional charges therefrom. 

All of our products are imported from Ecuador, and subject to inspection by U.S. Customs and Border Protection. We assume no responsibility if the delivered product(s) is delayed or damaged during inspection by U.S. Customs and Border Protection.  

Any failure or delay in performance by either party shall be excused if and to the extent caused by an Act of God (fire, flood, earthquake, volcano, storm, hurricane or other natural disaster), war or civil disorder, invasion, act of foreign enemies, hostilities, terrorism, riots, government actions, airport closure, lockout or interruption or failure of electricity of network service, or other cause beyond the reasonable control of the parties. 

Taxes  

Resale certificate or TAX ID number must be uploaded in your account or sent via email to: sales@flowersforflorist.com. If not registered, taxes will be calculated at checkout. 

Changes to Services and Agreement 

We expressly reserve the right to, at any time and from time to time, modify, suspend, or discontinue the Services or any parts thereof at our sole discretion. 

We expressly reserve the right to make changes to this Agreement, at any time and from time to time, as the Services change. Your continued use of the Services after a change to this Agreement constitutes your acceptance of the changes to this Agreement. If you do not agree to be bound by this Agreement, as modified, you must terminate your use of the Services immediately. It is your responsibility to review, from time to time, the most current version of this Agreement.
